Terms And Conditions – Rental Agreement – Rates & Fees

Effective 01-01-2024 – Any last minute reservation (within 15 days of arrival) guest will be required to register in person at our office with valid Drivers License and the Credit Card that was used at time of booking. There will be no ‘SAME DAY CHECK IN’S” FOR RESERVATIONS MADE AFTER 5:00PM.

Phones are answered Mon-Fri between 9am-5pm by the local office. If you call after hours or on weekends, your call will be answered by our after hours team who can answer general questions or reach out to us in case of an emergency. If you are asking for an early check in or late check out that must be done at least 24 hours in advance.  If you have a TRUE emergency call 911.

Guests acknowledge, understand, and agree that the moment Guests give their credit card information, Mountain Oasis Cabin Rentals is authorized to charge credit card for the rental amount agreed upon including required fees and the lodging tax % associated with their booking. Guest further acknowledges that any damages not reported and found upon departure shall be charged to the credit card on file.

Guest shall provide a guest list and driver’s license (of the credit card holder) prior to driving directions being sent (check in instructions emailed 7 days prior to arrival.) If a guest is found to exceed the maximum occupancy of your cabin, guest will be charged a minimum of $200 and it will be considered a breach of contract and may result in immediate eviction with NO REFUNDS. 

Please Note: if you are staying at a property that charges an additional fee for extra guest it will be noted on the listing and should be selected during the booking process. If you fail to select for extra guest MOCR will make the adjustment and the CC on file will be charged.

If you are staying in Coosawattee River Resort, please respond no later than 7 days prior to check in. Additional fees may apply if you choose to send in later than the 7 days.  Exception – for reservations that are last minute and are already within a week of arrival. 

GUEST MAKING RESERVATION AND ALL GUESTS AT PROPERTY MUST BE AT LEAST 25 YEARS OLD OR OLDER ,  except for those who are in the presence of their parent(s) or legal guardian(s.) By submitting your reservation you are confirming that you are 25 years old or older and that all of the guests are either 25 years or older, or any who are under 25 are with their parent(s) or legal guardian(s.)

Cancellations & Rescheduling

Cancellations, rescheduling, or changes must be submitted in writing and confirmed by Mountain Oasis Cabin Rentals no later than twenty-one (21) days prior to check-in date, in order to receive refund, less a $100 cancellation fee plus any applicable fees.  If cancellations, rescheduling, or changes are made less than twenty one (21) days prior to check-in date, NO REFUNDS will be given however, MOCR will work with them to re-book the cabin and if they are able to do so, a partial refund may be made. If booking through a site other than Mountain Oasis, our terms and conditions will still apply.  Guest further acknowledges that if they booked through another site other than Mountain Oasis and they cancel through that site, any cancellation fees charged to Mountain Oasis by OTA  the guest will be responsible for those fees. Guests understand that if they booked through a third party site such as VRBO, HOMEAWAY, AIRBNB, EXPEDIA, I.E. any site other than Mountain Oasis’s, will be held responsible for the cancellation policy that is put into place on that direct site. Mountain Oasis Cabin Rentals is not responsible for Guests inability to arrive or if Guests chooses to depart early for any reason, or if members of Guests party do not show up  NO REFUNDS OR REBATES will be offered.  Massage cancellations less than 48 hours prior to appointment will not be refunded.  Mountain Oasis Cabin Rentals reserves the right to cancel any reservation for non payment of final balance within allotted time (unless prior arrangements have been made) or for any charge backs to the card used to secure the reservation.  No refunds will be made in those cases.

Required Fees

Required fees, including the housekeeping fee, processing fee, and Home Guardian Plus Silver Protection fee, are automatically added to each reservation. Required fees may vary depending on the property.

For properties located inside Coosawattee River Resort, a Coosawattee River Resort fee will also be added to the reservation. This fee provides guests with access to the resort and its available amenities during their stay.

The Home Guardian Plus Silver Protection fee is $69 per booking for stays up to 29 days and is an insurance-backed property protection program that may provide coverage for certain accidental guest-related damages during a covered stay, subject to policy terms, conditions, exclusions, deductibles, and claim requirements.

This fee is not a security deposit and does not apply to the housekeeping fee. It also does not release guests from responsibility for intentional damage, guest negligence, policy violations, excessive cleaning, missing items, fines, or any costs not covered by the program.

Guests agree to contact Mountain Oasis Cabin Rentals immediately if any damages, defects, or maintenance concerns are noticed during their stay.

Housekeeping

Housekeeping fees include cleaning, linen services and amenities left for guest. Premises are to be left in a clean, undamaged condition, and Guests are asked to follow check-in and check-out procedures located in the cabin book. Properties have been cleaned and inspected prior to Guests arrival. If property is left in a condition that requires additional cleaning not normally having to be done (carpet cleaning, food left in pots and pans, etc.) an additional cleaning fee may be charged to the guest.  Guest would be notified prior to that charge taking place. 

Refunds

This Cabin Rental Agreement is a legally binding agreement between Guests,& Mountain Oasis Cabin Rentals. Your reservation binds you to a specific period of time.  Mountain Oasis Cabin Rentals will make every reasonable effort to correct any problem that arises during your stay in a timely manner. There should be no expectation of refund, and there will be no refund or relocation because you are disappointed with the property you have chosen to rent or in the event that something associated with the property is not working to your satisfaction. There will be no refunds or compensation for:  Acts of God, Mother Nature (ie Snow/Ice), acts of war or government agencies, road maintenance, gas shortages, power outages or water outages. Travel Insurance through RentalGuardian/InsureStays is made available to you at the time of booking at a very low cost.  See below: 

Travel Insurance

Mountain Oasis Cabin Rentals strongly recommends that guests consider purchasing travel protection through RentalGuardian/InsureStays to help protect their vacation investment. Trip insurance is available for as low as 7.5% of the booking total and may be added within 14 days after making your initial trip payment.

Travel protection may provide coverage for certain covered events such as illness, injury, trip interruption, weather-related issues, and other qualifying circumstances, subject to the specific policy terms, conditions, exclusions, and eligibility requirements.

Travel protection is optional and must be purchased separately by the guest. Mountain Oasis Cabin Rentals does not determine coverage, approve claims, or issue insurance reimbursements. All policy questions and claims must be handled directly through RentalGuardian/InsureStays. Declining travel protection does not alter the cancellation policy agreed to at the time of booking. Check In & Check Out Times

Check in time is 4:00 PM ; check-out is any time prior to 10:00 AM. Cabin will not be available until check-in time of 4:00 PM.  Guests acknowledges Agreement/Contract and authorizes Mountain Oasis Cabin Rentals to charge their credit card on file an amount up to one night’s rental for a check-in earlier than 4:00 PM or a check-out later than 10:00 AM. No Check-In’s allowed on Thanksgiving Day, Christmas Day or New Year’s Day if another guest is checking out on any of those days, resulting in the house having to be cleaned on those days. Those 3 days are reserved for our employees to spend time with their families.

Directions

Directions will be emailed seven (7) days prior to your arrival date providing the reservation has been paid in full and a guest list and a copy of the drivers license of the persons credit card that was used has been submitted.  To avoid getting lost, we highly recommend you DO NOT use GPS or internet mapping once you arrive in Ellijay. Please PRINT directions as cell service is not always available.   Mileage markers and landmarks are included to ensure your safe arrival.  If Guests leave home without directions, Mountain Oasis Cabin Rentals cannot be held responsible for Guests being unable to find their rental unit.   
Roads leading to some rental properties are dirt, gravel, bumpy and mountainous. Mountain Oasis Cabin Rentals is not responsible for conditions of road. NO REFUNDS will be offered. 

DOG Policy – Applies to Pet Friendly Properties

(Dogs Only Allowed) 2 DOGS 50# or under are allowed at our Dog Friendly Properties. Check your particular property to see if it is dog friendly. 

Guests acknowledge, understand, and agree that for Mountain Oasis Cabin Rentals to continue to offer DOG FRIENDLY CABINS these policies must be adhered to. Please notify us if your dog is over 50 pounds or for more than 2 dogs. Prior approval from office is needed and must be noted on your reservation.  

Dogs are only allowed in Dog Friendly Cabins.  If dogs are brought to a non dog friendly cabin, without prior approval, any security deposit will be forfeited and possibly an additional charge will be incurred. 

Dogs are not permitted in hot tub or pools. Guests agree to pay minimum $100 cleaning fee if pet gets in the hot tub and $250 if they get in any pool.

Dogs must be completely housebroken, well behaved, and pest free. 

A dog bed may be provided at our dog friendly cabin. Dogs are not allowed on furniture or on or in human beds. An additional fee will be applied if there is evidence of a pet being on furniture.

Dogs must be crated when left alone in cabin.  Locking a dog in a room is not permitted as this is when most damages occur. Guests agree to pay for any damages caused by dogs. If dogs have an accident in cabin, all clean-up will be performed by the Guests. Guests further agree to pick up waste from the grounds and deposit in outside garbage cans. Guests agree that failure to comply with clean-ups of either inside cabin or outside cabin will result in an additional cleaning charge of no less than $50. 

Guests agree to be in full control of their dogs at all times and take full responsibility for their pets. For your dog’s protection, they must be on a leash at all times when outside and be wary of other dogs.  You are surrounded by thousands of acres of forest, pets can get lost very easily. If any of these Pet Policy items are not met, Guests are in violation of this Agreement/Contract. Guests acknowledge Agreement/Contract and authorize Mountain Oasis Cabin Rentals to charge the credit card on file for any damages sustained. 

Conduct

Each of our properties are privately owned and not built to accommodate large number of tenants. Only the guests listed on the guest list are permitted at the cabin.  Our cabins are not venues for parties, reunions, etc. where the maximum occupancy exceeds the guest list, EVEN if guests are not spending the night.  Contact us if you have any questions regarding this policy.  Guests agree to the Gilmer County Noise Ordinance of quiet hours from 10:00pm to 8:00am, Sunday through Friday morning and from 11:00pm until 8:00am Friday evening through Sunday morning. Guests agree not to trespass on other peoples property, only the property in which they have made their reservation. No parking on roadways, streets, yards, only in designated areas for vehicles and guest understands that if they do, their vehicle may be towed at the owners expense and that they are in violation of the Gilmer County Short Term Rental Ordianance.

Non Smoking

All cabins are no smoking properties. This includes vaping, incense or anything that emits smoke, odor, etc. If you are unsure, you must call the office to get clarification. Guests agree to pay not less than $250 for odor abatement if they smoke in the cabin or if cigarette butts are left on the grounds. 

No drinking of alcoholic beverages by persons under the legal age of twenty-one (21) is allowed in rental properties.  Guests agree that if Guests are arrested for underage drinking at rental properties or if Mountain Oasis Cabin Rentals observes Guests under the legal age of twenty-one (21) drinking alcoholic beverages, this Agreement/Contract may be terminated and Guests evicted with no refund or rebate. Illegal drug use is strictly prohibited. 
Maximum occupancy is stated in all accommodation descriptions. Guest further agrees that each additional guest over the age of 4, including visitors, will be listed and on file with Mountain Oasis Cabin Rentals.  Roll away beds, inflatable mattresses & sleeping bags are prohibited unless approved in advance of arrival. 

Use of premises shall not be such as to disturb or offend neighbors or residents, including but not limited to; parties, excessive speeding through neighborhoods, riding of ATV’s or Off Road Motorcycles/Dirt Bikes, excessive noise and/or obnoxious behavior, discharging of Firearms, BB/Pellet Guns, Paint Ball Guns, or Fireworks, etc.  Mountain Oasis Cabin Rentals reserves the right to terminate this Agreement/Contract and to demand that disruptive Guests vacate the premises, thereby forfeiting all monies to Mountain Oasis Cabin Rentals. Noise carries in the mountains, refrain from making excessive noise between the hours of 10 pm – 8 am.  NO REFUNDS OR REBATES will be offered. Any violation of the above terms of conduct will result in immediate eviction. NO REFUNDS OR REBATES will be offered. 

Amenities

CABLE/SATELLITE TV – Mountain Oasis Cabin Rentals cannot guarantee TV channel availability. Some Rental properties offer premium packages, i.e., Movie Channels, Sports Channels, etc. but not all do. Most properties are now providing Smart TV’s for streaming. Mountain Oasis Cabin Rentals nor the guest, cannot under any circumstance activate premium channels. If guests unplug anything from the TV’s or their devices and they are not reconfigured correctly, resulting in a reconnection service call, guest will be charged accordingly, not less that $75.00.

Furnishings/Furniture 

All furnishings/furniture in the cabin are in place as the owners wish them. Guests agree to pay not less than $100 if furniture is rearranged in such a manner that results in cleaning services being delayed. Guest further acknowledges that furniture/furnishings are replaced periodically as needed and as a result, the pictures on website may not be an exact replica of what is actually in the cabin. 

Long Distance Calls

Cabin telephones are toll restricted and do not permit long distance calls except for calling card calls, credit card calls, collect calls, valid third party calls, and emergency (911) calls.  Guests agree that any special feature calls including but not limited to; Call Return, Call Block, Call Forward that Guests activates will be billed to Guests credit card on file plus a $15 service charge per incidence. Cell phone coverage varies by carrier and signal strength may be poor or non-existent in some areas. 

Propane Grills

Properties with propane grills are fueled by liquid propane, and under NO circumstances may Guests add charcoal or any derivative of charcoal to the propane grills.  Guests agree that if Guests add charcoal to a propane grill, Mountain Oasis Cabin Rentals is authorized to charge not less than $100 to Guests credit card for cleaning of grill. 

Fireplaces & Fire Pits

(fireplace season is Oct 1-Apr 15; FIRE PITS year around use)
DO NOT LEAVE BURNING OR SMOLDERING FIRES UNATTENDED 
Guests acknowledge, understand, and agree that gas log fireplaces are seasonal and are only operational from October 1st through April 15th. This goes for wood burning as well as gas fireplaces.  GAS LOG FIREPLACES: If you have a cabin with gas logs, no other items may be burned in gas log fireplace, including but not limited to; sticks, wood, charcoal, lava rocks, etc. Gas logs may not be moved or re-stacked; guest agrees to pay not less than $200. if logs have been moved.

Wood burning fireplaces inside and outside the home adhere to the same seasonal dates as the gas log fireplaces, however, exceptions to this are authorized if unpredictable weather intrudes. ONLY the 4 to 6 Hour Firelogs (such as Duraflame) are to be used in ALL wood burning fireplaces. This has been implemented for guest safety as well as owners protection due to the multiple damages caused to fireplaces by guests overloading the fireplaces, causing extreme heat, creating a high safety concern for all. One firelog will be supplied for each word burning fireplace and only 1 log should be used a time.  If you have a wood burning fireplace that has a gas line you are not permitted to use the gas (key) as they have been capped off and no gas is available. FIRE PITS – Guests acknowledge, understand, and agree that fire pits may be used year round, however, firewood is NOT provided for use in the fire pits. Guests must provide their own wood to burn in fire pits. If a property does not offer a fire pit guests will not make one. Guests agree to pay not less than $250, if anything other that the approved firelog is used in wood burning fireplaces.. 

Hot Tubs – Pools

Guests may not add any objects, soaps or chemicals to the hot tubs or pools. Guests agree to pay not less than $100, if hot tub or pool has been compromised in such a manner that results in cleaning services being delayed. Hot tubs & pools have been cleaned prior to Guests arrival. Guests agree to pay an additional charge of $50 if Guests request an additional cleaning of hot tub during stay.  Guests understand that hot tub & pool usage is at their own risk and guests agree they will not hold Mountain Oasis Cabin Rentals or Property Owner responsible for any injury or reaction from it’s use.  It is absolutely forbidden for children to be in the hot tub or pool without a responsible adult.  Dogs are not allowed in the pool or the hot tub and if there is evidence that they have been there will be a charge of not less than $200.  Pool/Hot Tub Rules are posted at the property and guest agrees to adhere to them.   

Maintenance Issues

In case of a breakdown of any property equipment, guests shall notify Mountain Oasis Cabin Rentals immediately. We will make every reasonable effort to correct any problem that arises during your stay in a timely manner. We cannot guarantee; heat, air conditioning, electricity, water, any appliances, cable, satellite, television, telephones, electronics, gas logs, grills, etc. NO REFUNDS OR REBATES will be given. Should a repair person make a call to repair or replace a unit that is found to be in non-working order and the problem was due to Guests oversight, neglect or misuse, Guests agree that the repair call costs may be billed to the Guests credit card on file. 

Lock Out

A lock out of Guests from cabin will result in a $75 service call during business hours. Guests agree that a lock out after business hours will result in a fee of $125 to send someone out from company or a locksmith being called and Guests credit card being charged accordingly. 

Key Return

Guests are responsible for the return of the property key.  They are to be returned to the lock box or as instructed in the cabin. If the property key is not returned upon check-out, Guests agree that Mountain Oasis Cabin Rentals is authorized to charge the credit card on file not less than $100 for the costs of re-keying or replacing all of the locks and re-issuing new keys to owners, cleaning crews, and Mountain Oasis  Cabin Rentals. 

Bear – Deer – Snakes – Ladybugs – Insects

Guests are in the mountains and woods and depending upon the time of year may encounter Bear, Deer, Turkey, Ladybugs, Carpenter Bees, Wasps, Scorpions, Snakes, Ticks, Ants, Chiggers, Squirrels, Mice/Rats, or any kind of pest or insect,  etc.  Guests are encouraged to dress accordingly and to bring insect repellent for outdoor activities. NO REFUNDS will be give because you have encountered one of these pests, whether inside or outside of the property.

Construction

Guests acknowledge, understand, and agree that construction of new accommodations and 
attractions occur. NO REFUNDS OR REBATES will be offered for inconveniences due to but not limited to; construction, construction noise, road repair, and maintenance.  Routine maintenance is sometimes required while a guest is at a property (grass cutting, weed eating, blowing leaves).  If this does occur, it will not happen before 9:00 am and every effort will be made not to disturb the guest. Lawn services will not be rescheduled due to a guest not wanting to “hear” a lawn mower, weedeater or blower.

Right Of Entry

Guests acknowledge, understand, and agree that Mountain Oasis Cabin Rentals reserves the right to enter property at any time to investigate disturbances, check occupancy, check damages, make repairs, alterations, and improvements.

Items Left At Cabin

Mountain Oasis Cabin Rentals is not responsible for any items Guests leaves behind in cabin, however, if items are found we will make an effort to contact guest to see if guest would like items shipped to them. A fee of $50 plus shipping costs for the return of any item will be charged to guest credit card.  Items will be discarded or donated after 7 days, any exception to this must be confirmed by MOCR by way of email.

Required Fees

The “required fees” which includes cleaning, processing, resort gate fees, accidental/unintentional damage up to $350, etc., is automatically added to each reservation. The required fees differ depending on the property. The damage waiver will cover unintentional accidents which may have caused damage up to $350.00 but must be reported during the guests stay.  Any damages that occur due to guest negligence is not considered unintentional and shall be at the guests expense.  Required fees are not refundable.

Damages To Property

Premises are to be left in clean, undamaged condition, and Guests must follow check-in and check-out procedures located in the cabin book or in kitchen, along with the pet policy. Properties have been cleaned and inspected prior to Guests arrival.  Guests agree to call Mountain Oasis Cabin Rentals if any damages or defects are noticed. If property is left in a condition that requires additional cleaning not normally having to be done (carpet cleaning, food left in pots and pans, etc., an additional cleaning fee may be charged to the guest.  Guest would be notified prior to that charge taking place.

Agency Disclosure

Mountain Oasis Cabin Rentals serves as the Agent and represents the owners of vacation properties in its rental program, and is acting at all times, in and for the best interest of the owners. Guests are a licensee of the Owner and not a tenant; and Guests are not acquiring any interest in the property. 

Mountain Oasis Cabin Rentals strives to comply with all reservation requests for specific vacation properties. However, due to ownership changes, properties being removed from rental program, mechanical problems, or other unforeseen circumstances, Mountain Oasis Cabin Rentals cannot absolutely guarantee a specific property. Mountain Oasis Cabin Rentals reserves the right to change property unit assignment without liability should rental property become unavailable.  Where comparable properties are not available Guests will have the option of selecting from available properties at the published rate or receiving a complete refund. 

Mountain Oasis Cabin Rentals reserves the right to refuse service to anyone.  All rental properties are leased without regard to race, color, religion, sex, national origin, or handicap. Information regarding individual listings is believed accurate but cannot be guaranteed.

Violation Of Terms & Conditions

Guests acknowledge, understand, and agree that Mountain Oasis Cabin Rentals reserves the right to remove renter, if any of the of Agreement/Contract items are not met.  NO REFUND OR REBATE will be offered. 

Expedited Eviction

A material breach of this Agreement by Guests, which, in the sole determination of Mountain Oasis Cabin Rentals, results in damage to the Premises, personal injury to Guests or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guests tenancy.  Violation of any of the rules contained herein will result in IMMEDIATE EVICTION and forfeiture of rent and security deposit.  If the tenancy created here under is for 30 days or less, the expedited eviction procedures set forth in the Cabins Act will apply.  Guest(s) may be evicted under such procedures if Guest(s):

• hold over in possession after Guest(s) tenancy has expired;
• commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Guest(s) tenancy;
• fail to pay rent as required by this Agreement, or
• have obtained possession of the Premises by fraud or misrepresentation. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in.

Disputes

This Agreement/Contract shall be governed by and interpreted in accordance with the laws of the State of Georgia and be treated as though it were executed in the County of Gilmer, State of Georgia.  Any action relating to this Agreement/Contract shall be instituted and prosecuted only in the Gilmer County Superior Court, Ellijay, Georgia. Guests specifically consent to such jurisdiction and to extraterritorial service of process. 

Indemnification & Hold Harmless

Guests acknowledge, understand, and agree that Guests shall be solely responsible for any property damage, accident or injury to any person or loss sustained by any person, including loss of money, jewelry, and other items of personal property, arising out of or in any way related to Guests use of the premises or the items of personal property provided by Mountain Oasis Cabin Rentals, the Owner at Guests request.  Guests shall inspect and be familiar with proper use and application of such items prior to using them.  Guests hereby agree to INDEMNIFY and hold Mountain Oasis Cabin Rentals, employees, owners and officers; and/or Homeowners harmless from any and all claims including those of third parties, arising out of or in any way related to Guests use of premises or the items of personal property provided therein. Guests hereby agree to hold Mountain Oasis Cabin Rentals and/or homeowner, employees and officers harmless and to indemnify same against any and all claims which may arise during and after the course of rental as a consequence of any acts or omissions of Mountain Oasis Cabin Rentals and/or cabin owner, employees and officers.  Guests assume the risk of injury or other losses relating to any recreational activities and will hold owner and Mountain Oasis Cabin Rentals harmless with respect there to.

Internet Access Terms Of Use 

Mountain Oasis Cabin Rentals, Inc., and Cabin Owners/Account Holder as part of this rental package for all properties offered for rental by MOCR, offers access to internet service provided through an account with ETC.  The undersigned renter, requesting and accepting the inclusion of this access as part of the rental package, agrees to abide by the provisions of the Acceptable Use Policy and Terms of Service of ETC which may be viewed at http://etcnow.com under “Terms and Conditions” and to the additional terms and conditions set forth below:     

• Changes to the system may be made by service provider ETC during your use.  Mountain Oasis Cabin Rentals and Property Owners/Account Holder is not responsible for degraded or interrupted services.  All information you receive from or through the account is provided “as-is” “as available” and all warranties, express or implied are disclaimed.  If you are dissatisfied with the internet access, you may immediately discontinue use, such being your sole remedy, and understand that and agree that access to this service would not be made available to you without these limitations.
• Access is furnished subject to the condition that it will not be used for unlawful purpose.
• You certify that you are 25 years of age or older and that minors use of the service during your rental period shall be deemed to be with your express permission. and that as renter, you are solely responsible for the actions of the minor in using this account.
• You further understand and agree that permission to use passwords or access codes to access codes to access to this internet account/service terminates upon termination of your rental contract.
• You agree to defend, indemnify, and hold Mountain Oasis Rentals, Inc., and Property Owner/Account Holder harmless from any and all liabilities, costs, and expenses, including reasonable attorney’s fees, related to or arising from any violation of this agreement by you or those who access the service and account through you, and the use of service of the internet and the placement or transmission of any message, information, software, or other materials on the internet by you or those who have access to the service through you. By accepting the terms of this rental agreement, you are agreeing to the terms of the Acceptable Use Policy and foregoing provisions and take full responsibility of addressing the conditions and policies of access and use of the internet to all members of my party.
